POLSKI

1.  Przedmiotem aukcji są dzieła sztuki i inne obiekty oddane do sprzedaży komisowej przez komitentów lub stanowiące własność firmy MILITARISTA.

2. Aukcja prowadzona jest przez Aukcjonera, który decyduje o wysokości postąpień, rozstrzyga ewentualne spory lub poddaje obiekt ponownej licytacji. Wylicytowana cena jest równoznaczna z zawarciem umowy kupna-sprzedaży.

3. MILITARISTA gwarantuje zgodność cech licytowanych obiektów z opisem katalogowym zastrzegając sobie możliwość zmiany opisu przed aukcją lub wycofania obiektu z aukcji.

4. Do udziału w aukcji nie jest wymagana wpłata kaucji. Wylicytowanie pozycji jest równoznaczne z zawarciem umowy kupna – sprzedaży.

5. Nabywca zobowiązany jest do wykupu obiektu/obiektów w ciągu 7 dni od zakończenia aukcji. 

6. Koszt wysyłki wynoszą niezmiennie na terenie Polski 25 zł natomiast za granicę 50 zł.

7. PRZESYŁKA ZOSTANIE WYSŁANA W TERMINIE DO 10 DNI ROBOCZYCH OD DATY ZAKSIĘGOWANIA PŁATNOŚCI NA KONCIE BANKOWYM LUB WSKAZANYM KONCIE PAYPAL.

8. Prawo własności do wylicytowanego obiektu i jego odbiór następuje po zapłacie przez nabywcę całości wylicytowanej kwoty wraz z opłatą organizacyjną.

9. Do wylicytowanej ceny doliczana jest opłata organizacyjna w wysokości 20%, a w przypadku obiektów, których twórca  zmarł w okresie krótszym niż 70 lat od daty aukcji lub twórców żyjących również opłata droit de suite w wysokości 5%. Wyżej wymienione opłaty obowiązują również w sprzedaży poaukcyjnej i są kwotami brutto.

10. MILITARISTA nie ponosi odpowiedzialności za ukryte wady fizyczne i prawne zakupionych obiektów, a wszelkie reklamacje będą rozpatrywane na podstawie przepisów prawa polskiego.

11. W sprawach nieunormowanych mają zastosowanie przepisy kodeksu cywilnego.

12. Niniejszy Regulamin stanowi całość uzgodnień pomiędzy Domem Aukcyjnym a Licytującymi oraz zastępuje jakąkolwiek wcześniejszą umowę czy porozumienie (czy to ustną, czy pisemną) pomiędzy Domem Aukcyjnym a Licytującymi dotyczącą materii objętych przedmiotem niniejszego Regulaminie. Jeżeli jakakolwiek część niniejszego Regulaminu zostanie uznana przez sąd właściwy lub inny upoważniony podmiot za nieważną, podlegającą unieważnieniu, pozbawioną mocy prawnej, nieobowiązującą lub niewykonalną, pozostałe części niniejszego Regulaminu będą nadal uważane za w pełni obowiązujące i wiążące, a Dom Aukcyjny i Licytujący działając w dobrej wierze zastąpią takie postanowienie postanowieniem ważnym i wykonalnym, które będzie najpełniej oddawać ekonomiczny sens pierwotnego zapisu.

ENGLISH

1. The subject of the auction are works of art and other objects submitted for sale on commission by commissioners or owned by MILITARISTA.

2. The auction is conducted by the Auctioneer, who decides on the bidding amount, resolves any disputes or puts the item up for auction again. The bid price is tantamount to concluding a purchase and sale agreement.

3. MILITARIST guarantees compliance of the features of the auctioned items with the catalog description, reserving the right to change the description before the auction or withdraw the item from the auction.

4. No deposit is required to participate in the auction. Bidding on an item is tantamount to concluding a purchase and sale agreement.

5. The buyer is obliged to purchase the object/objects within 7 days from the end of the auction. 

6. Shipping costs are always PLN 25 within Poland and PLN 50 abroad.

7. THE PARTICIPATION WILL BE SHIPPED WITHIN 10 BUSINESS DAYS FROM THE DATE OF RECEIVING THE PAYMENT IN THE BANK ACCOUNT OR THE SPECIFIED PAYPAL ACCOUNT.

8. Ownership of the auctioned item and its collection takes place after the buyer pays the entire auctioned amount together with the organizational fee.

9. An organizational fee of 20% is added to the auctioned price, and in the case of objects whose creator died less than 70 years from the auction date or of living creators, also a droit de suite fee of 5%. The above-mentioned fees also apply to post-auction sales and are gross amounts.

10. MILITARIST is not responsible for hidden physical and legal defects of purchased objects, and all complaints will be considered on the basis of Polish law.

11. In matters not regulated, the provisions of the Civil Code shall apply.

12. These Regulations constitute the entire arrangements between the Auction House and the Bidders and supersede any previous agreement or understanding (whether oral or written) between the Auction House and the Bidders regarding the matters covered by the subject matter of these Regulations. If any part of these Regulations is found by a court of competent jurisdiction or other authorized entity to be invalid, voidable, deprived of legal force, inapplicable or unenforceable, the remaining parts of these Regulations will continue to be considered fully valid and binding, and the Auction House and the Bidder, acting in good faith, faith will replace such a provision with a valid and enforceable provision that will most fully reflect the economic meaning of the original provision.
